Supreme Court Grants Extension: But Orders, “Conduct the Elections”

New Delhi | The State Election Commission had submitted a petition in the Supreme Court seeking an extension till the end of January 2026 for conducting the pending local self-government elections in Maharashtra. The hearing was held on Tuesday (16th September). On this occasion, the Supreme Court granted the State Election Commission an extension till 31st January 2026. Now, the Election Commission will have to conduct these elections before 31st January.

Therefore, instead of being complacent under the impression that the elections will be postponed further, aspirants must work with even greater energy. The election process will be completed by January 31, and candidates will get only 3 months of preparation time.

Today, the hearing on the matter of local self-government elections in Maharashtra was conducted in the Supreme Court. At that time, the court granted an extension till 31st January 2026. This has brought major relief to both the Election Commission and the State Government. To obtain this extension, the Commission had cited reasons such as shortage of staff, the EVM issue, festivals, and other factors. Taking these into account, the Court granted the Commission additional time to hold the elections.

The elections to local self-government bodies in the state had been delayed for the past four to five years due to OBC reservation issues and other reasons. Finally, during the hearing held in May, the Supreme Court lifted the stay on the elections and directed the Election Commission to complete the process within four months, i.e., by October 2026. Accordingly, the Commission began processes such as ward restructuring, reservations, and updating of voter lists. However, citing staff shortages and other issues, the Commission requested an extension to conduct the elections. The Court has now accepted this request.

Finger Pointed at the Negligence of the Election Commission and State Government…

Meanwhile, while granting the extension, the Supreme Court clearly stated that all types of elections must be completed by 31st January 2026. It also directed the State Election Commission to pursue any pending demands with the State Government. The Supreme Court told the Commission to write to the Chief Secretary of the state regarding demands for EVMs and staff. The Court has also given the Commission a timeline regarding how all demands will be fulfilled and what the stages of work will be.

“The Election Commission, which earlier said it would conduct elections within four months, now appears to have shown negligence,” the Court also remarked during the hearing.
